Welcome to InfluenceOwl (“we,” “our,” or “the Service”). These Terms & Conditions (“Terms”) govern your access to and use of the InfluenceOwl platform, including our hosted landing pages, personalization engine, JavaScript snippet, Shopify integrations, websites, mobile interfaces, and all related services (collectively, the “Platform”).

By creating an account, accessing the Platform, or using any part of InfluenceOwl, you agree to these Terms.

If you do not agree, you must discontinue use immediately.

1. Eligibility

To use InfluenceOwl, you must:

​

• Be at least 18 years old

• Have the legal authority to enter binding agreements

• Use the Platform only for lawful business purposes
   

2. Description of Service

​

InfluenceOwl is a personalization platform that allows D2C brands and marketers to:

​

• Deploy personalized landing pages hosted on a custom subdomain

• Use a lightweight JS snippet to dynamically swap page elements

• Pre-personalize Shopify pages (future release)

• Manage campaigns, audiences, personalized content, and UTM-based experiences
   

InfluenceOwl may update, modify, or discontinue parts of the Platform at any time.

3. Account Registration
 

You are responsible for:
 

• Maintaining accurate account information

• Keeping your login credentials confidential

• All activity that occurs under your account
   

InfluenceOwl is not liable for unauthorized access resulting from your actions or inactions.
 

4. Acceptable Use

You agree not to:

​

• Use the Platform for any unlawful, fraudulent, or harmful activity

• Reverse engineer, copy, or attempt to access source code

• Interfere with the Platform’s operation or infrastructure

• Send malicious scripts, harmful UTM parameters, or automated bots

• Use InfluenceOwl to deliver deceptive, misleading, or non-compliant marketing content
   

We reserve the right to suspend or terminate accounts violating acceptable use.

5. Customer Content
 

You retain ownership of all content you upload or personalize through InfluenceOwl ("Customer Content").
 

By using the Platform, you grant us a non-exclusive, royalty-free, worldwide license to host, store, process, and display your content solely for the purpose of providing the Service.
 

You represent and warrant that:

• You have the rights to all content you upload

• Your content does not infringe any third-party rights

• Your content complies with all applicable advertising and privacy laws
   

6. Subdomain & Script Usage
 

When connecting a subdomain or installing our script:
 

• You are responsible for DNS configuration

• You are responsible for any platform content displayed to end users

• We may automatically process visitor data to provide personalized experiences
   

InfluenceOwl is not responsible for any downtime caused by your hosting provider, DNS provider, or third-party software.
 

7. Data & Privacy
 

InfluenceOwl processes limited user interaction data for the sole purpose of personalization and analytics, including:
 

• UTM parameters

• Page interactions

• Visit/session data

• Browser/device information
   

We do not sell personal data.

You are responsible for complying with applicable privacy laws (e.g., GDPR/CCPA) and ensuring your users are properly informed of tracking and personalization behavior.

8. Pricing & Billing
 

Pricing may vary by plans or usage tiers (e.g. campaigns, personalization volume, integrations).
 

• Fees are billed monthly or annually

• All payments are non-refundable unless required by law

• Free trials may be revoked or changed at any time
   

Failure to pay may result in account suspension or termination.
 

9. Service Availability
 

We strive to maintain a high level of uptime and reliability, but we do not guarantee:
 

• Uninterrupted service

• Error-free functionality

• Perfect personalization accuracy
   

Maintenance, outages, or updates may affect service occasionally.
 

10. Intellectual Property
 

InfluenceOwl owns all rights to:
 

• Software code

• Designs, branding, mascot and UI (per brand book)

• Documentation

• Platform features and architecture
   

You may not copy, duplicate, or create derivative works based on the Platform.
 

11. Third-Party Integrations
 

When using Shopify, Webflow, or any external services:
 

• You agree to their respective terms

• We are not responsible for changes or failures in third-party platforms

• Removing external access may break personalization features
   

12. Termination
 

We may suspend or terminate your account if:

• You violate these Terms

• You fail to pay required fees

• You engage in fraudulent or harmful activity
   

You may cancel at any time by contacting support or canceling in your dashboard.
 

Upon termination, your access to campaigns and personalized pages will cease immediately.
 

13. Disclaimer of Warranties
 

InfluenceOwl is provided “as is” and “as available.”

We make no guarantees regarding:
 

• Increased conversion performance

• Accuracy of personalized content

• Compatibility with all themes, browsers, or environments
   

Use of the Platform is at your own risk.
 

14. Limitation of Liability
 

To the maximum extent permitted by law:
 

• InfluenceOwl is not liable for indirect, incidental, or consequential damages

• Total liability will not exceed the amount paid in the previous 3 months
   

This limitation remains in effect even if we are aware of potential damages.
 

15. Indemnification
 

You agree to indemnify and hold InfluenceOwl harmless from any claims, damages, or losses arising from:
 

• Your use of the Platform

• Your content

• Your violation of these Terms

• Your violation of any laws or regulations
   

16. Changes to Terms
 

We may update these Terms at any time. Continued use of the Platform indicates acceptance of updated Terms.
